OFFICIAL RULES, PARTICIPATION AGREEMENT, AND PRIVACY NOTICE

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PLAY OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

THIS AGREEMENT IS VOID WHERE PROHIBITED BY LAW.

1. CONTEST DESCRIPTION

The Acme Fresh Market “Scratch and Win” Contest (“Contest”) consists of a scratch-off game ticket (“Scratch and Win Ticket”) and an online Grand Prize entry.

Each Scratch and Win Ticket gives customers the opportunity to:
- Instantly win a prize (a “Free Item Prize” or “Instant Win Prize”); and
- Receive a unique code that may be entered at acmestores.com for a chance to win the Grand Prize.

Internet access, a valid email address, and an acmestores.com account are required to participate in the online Grand Prize entry.

Participation in the Contest constitutes acceptance of these Official Rules and Acme Fresh Market’s Privacy Policy, available at acmestores.com

2. CONTEST PERIOD

The Contest begins at 12:00:00 a.m. Eastern Time on January 8, 2026.  Scratch and Win Tickets will be distributed at all Acme Fresh Market stores between January 8, 2026 and 8:59:59 p.m. Eastern Time on January 21, 2026 (the “Contest Period”).  Scratch and Win Tickets can be redeemed for Instant Win Prizes and unique codes can be entered for the chance to win the Grand Prize until 11:59:59 p.m. Eastern Time on January 28, 2026.  Sponsor’s computer is the official timekeeping device.

3. SPONSOR AND PARTICIPATING VENDORS

This Contest is sponsored and administered solely by Acme Fresh Market, 2700 Gilchrist Road, Akron, Ohio 44305 (“Sponsor”).

From time to time, certain manufacturers, distributors, or other business partners (“Participating Vendors”) may provide funding, promotional support, or prizes for this Contest.

Participating Vendors are not sponsors or administrators of this Contest and are not responsible for the administration of the Contest.

All trademarks remain the property of their respective owners.

5. ELIGIBILITY                  

The Contest is open to legal residents of Ohio who are 18 years of age or older as of the Contest start date (January 8, 2026), subject to the restrictions below.

 Employees, officers, and directors of Acme Fresh Market, its affiliates, and its advertising and promotional agencies, and their immediate family members or household members are not eligible to participate in the entry for or to win the Grand Prize.  Employees, officers, and directors of Acme Fresh Market, its affiliates, advertising and promotional agencies, and their immediate family members or household members are eligible to win Instant Win Prizes.

For purposes of this Contest, “immediate family members” means any parent, sibling, spouse, or children of an employee, officer, or director of Acme Fresh Markets, its affiliates, or its advertising and promotional agencies. For purposes of this Contest, “household members” means any individual who resides at the same address of an employee, officer or director of Acme Fresh Markets, its affiliates, or its advertising and promotional agencies. 

The Contest is void where prohibited by law.

6. HOW TO OBTAIN A SCRATCH AND WIN TICKET

Scratch and Win Tickets may be obtained either with or without purchase.

(a) With Purchase: During the Contest Period, customers who make a Qualifying Purchase and scan their Acme Fresh Market Savings Card in a single transaction at any Acme Fresh Market location will receive one (1) Scratch and Win Ticket from the cashier at checkout, while supplies last.  Customers using self-checkout must bring a receipt evidencing a Qualifying Purchase to the self-checkout attendant or customer service to receive their Scratch and Win Ticket on the same date in which the Qualifying Purchase was made. Limit one (1) Scratch and Win Ticket per Qualifying Purchase per day. 

For purposes of this Contest, a “Qualifying Purchase” means a purchase of $35 or more in a single transaction, excluding purchases of prescriptions, lottery, tobacco, adult beverages, gift cards, any other items prohibited by law from qualifying, and other service sale items.

(b) Without Purchase (Mail-In Request): To receive a Scratch and Win Ticket without making a purchase, the participant must mail a legibly handwritten, self-addressed, stamped #10 business envelope to:

Each outer envelope must include your full name, street address, city, state, and ZIP code. Limit one (1) Scratch and Win Ticket per request. Requests must be (i) handwritten, (ii) postmarked by January 17, 2026, and (iii) received by January 20, 2026.

Requests that are photocopied, computer-generated, mechanically reproduced, sent in bulk, or noncompliant with these requirements will not be honored. Acme Fresh Market is not responsible for lost, late, incomplete, illegible, or misdirected mail.

All mail-in requests received after January 20, 2026, or postmarked after January 17, 2026, will be deemed ineligible. Please note that although mail-in requests will be honored up until January 20, 2026, Acme Fresh Market does not guarantee receipt of the Scratch and Win Ticket by the participant prior to the drawing for the Grand Prize or the deadline to redeem the Scratch and Win Tickets.

7. HOW TO PLAY

Scratch the designated area on your Scratch and Win Ticket to reveal whether you have won an Instant Win Prize.

All tickets also include a unique code that may be entered at acmestores.com/win during the Contest Period for a chance to win the Grand Prize. Each code may only be used once. The code must be entered by January 20, 2026 for a chance to win the Grand Prize.

Winning a Free Item Prize or Instant Win Prize does not increase or affect your chances of winning the Grand Prize.

8. PRIZES

Instant Win Prizes: Certain tickets will reveal either a Free Item Prize redeemable at any Acme Fresh Market location or a coupon for at least $1 off a designated item or items.

Mid-Size Instant Win Prizes:

There are ten (10) Mid-Size Instant Win Prizes available to be awarded throughout the Contest Period.

Each Mid-Size Instant Win Prize consists of a $100 Acme Fresh Market Gift Card (Approximate Retail Value: $100).

To claim a Mid-Size Instant Win Prize, the potential winner must bring their original winning Scratch and Win Ticket to the Customer Service Desk at any Acme Fresh Market location during normal business hours on or before January 28, 2026.

Customer Service staff will verify the winning ticket and issue the $100 gift card to the verified winner.

Mid-Size Instant Win Prizes are not transferable, not redeemable for cash, and may not be exchanged or replaced if lost or stolen.

Grand Prize: One (1) Grand Prize Winner will receive “Free Groceries for a Year”. 
The Grand Prize of “Free Groceries for a Year” will be awarded solely in the form of Acme Fresh Market gift cards totaling $5,200.  However, in Acme Fresh Market’s sole discretion, a prize of equal value may be substituted.  

All valid online entries submitted with a unique code during the Contest Period are eligible for the Grand Prize drawing. The winner will be selected at random from all eligible entries on or about January 22, 2026.

The approximate retail value of the Grand Prize is $5,200.

General Information:

All taxes on prizes are the sole responsibility of the winner. The Grand Prize winner will be required to complete an IRS Form W-9 and will receive a Form 1099-MISC reflecting the prize value for the 2026 tax year, and all other winners should consult with a tax professional regarding the tax implications of the prizes.

No substitutions, cash equivalents, or transfers of prizes are permitted except at Sponsor’s discretion.

Odds of winning an Instant Win Prize, Mid-Size Prize or the Grand Prize depend on the total number of tickets printed, distributed, and entries received. No specific odds are represented or guaranteed.

9. PRIZE CLAIM AND REDEMPTION

Instant Win Prizes must be redeemed at the customer service desk or checkout at any Acme Fresh Market location by January 28, 2026. 

The Grand Prize Winner will be selected at random and notified by email and/or phone. The Winner must respond within seven (7) business days and may be required to complete an affidavit of eligibility, liability release, a publicity release, and IRS Form W-9 (if applicable).

All signed releases become the property of Acme Fresh Market and will not be returned.

Failure to respond within the time stated, or failure to meet eligibility requirements, will result in forfeiture of the prize. All taxes on prizes are the sole responsibility of the winner. No substitutions, cash equivalents, or transfers of prizes are permitted except at the Sponsor’s sole and absolute discretion.

10. LIMITATION OF LIABILITY AND RELEASE

By participating, entrants agree to release and hold harmless Acme Fresh Market, its affiliates, officers, employees, agents, and advertising agencies, and the Participating Vendors (collectively, the “Released Parties”) from any and all claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising out of the entrant’s participation in the Contest, acceptance, possession, use, or misuse of any prize, or any other claim related to the Contest.

Released Parties are not responsible for technical errors, printing errors, lost tickets, tampering, or unauthorized use. All redeemed tickets become the property of Acme Fresh Market and will not be returned.

11. NO PURCHASE NECESSARY COMPLIANCE

This Contest is not a lottery. No purchase or payment is required to obtain a ticket or win any prize. The free mail-in method described above provides an equal opportunity to participate and win. Both purchase and non-purchase entries are treated identically in all drawings.

12. PRIVACY NOTICE

Information collected from participants is subject to Acme Fresh Market’s Privacy Policy, available at acmestores.com/privacy. By entering, participants consent to the collection and use of their information for the administration of this Contest and for being contacted at regarding potential prizes.

During the entry process, participants may be offered the opportunity to opt in to receive marketing communications from Acme Fresh Market, including offers, promotions, and updates about products and services. Opting in to marketing communications is voluntary and not required to participate in or win this Contest.

Participants who choose to opt in will receive marketing communications in accordance with Acme Fresh Market’s Privacy Policy and may unsubscribe or withdraw consent at any time by following the unsubscribe instructions in any email from Acme Fresh Market.

Acme Fresh Market may use information from participants in accordance with its Privacy Policy, including the use or sharing of aggregated or de-identified information that does not personally identify any individual participant.

13. DISQUALIFICATION AND INTEGRITY

Acme Fresh Market reserves the right to disqualify any individual who tampers with the Contest process, attempts to defraud, or acts in violation of these Official Rules. Any attempt to undermine the legitimate operation of the Contest may result in civil and criminal prosecution.

14. DISPUTE RESOLUTION

All disputes, claims, and causes of action arising out of or related to this Contest shall be resolved individually, without resort to any form of class action, exclusively in the state or federal courts located in Summit County, Ohio, and shall be resolved in accordance with the laws of the State of Ohio. Entrants agree to personal jurisdiction of those courts and waive any right to trial by jury.

15. VOID WHERE PROHIBITED

This Contest is void outside Ohio and wherever prohibited by law.

All federal, state, and local laws apply. Sponsor reserves the right to modify, suspend, or cancel the Contest, in whole or in part, if fraud, technical failures, printing errors, human error, tampering, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion.

If the Contest is terminated before the scheduled end date, Sponsor may, at its discretion, conduct the Grand Prize drawing from among all eligible entries received as of the termination date.

Sponsor further reserves the right to disqualify any individual who tampers with the entry process or violates these Official Rules.

Entry time frames and conditions to be defined on a contest to contest basis.

No substitution, transfer, or cash redemption of prize permitted, provided however that Acme Fresh Market reserves the right to substitute a prize with another prize of equal or greater value in its exclusive discretion. Selected Entrant is solely responsible for any and all federal, state, and local taxes on prize.

If prize notification or any prize is returned as undeliverable, prize will be forfeited and an alternate Selected Entrant may be selected. Sponsor will not make multiple attempts to contact Selected Entrants.

No purchase is necessary to participate or win. To participate by mail, send an envelope containing a standard letter size paper with the Date of Entry, along with your name, address, zip code, phone number and email address. Only one entry per envelope will be recorded. Mail to Acme Fresh Market Stores / [Contest Name] / 2700 Gilchrist Road, Akron, Ohio 44305. Any written entry must be post-marked by the end date of the contest.

These official registration rules will be available on-line at www.acmestores.com.

Any late, lost, illegible, misdirected, or incorrect entries will not be eligible for this contest. You must be at least 18 years or older to participate.

All contest decisions made by Acme Fresh Market are final.
